What Are the Requirements for Canada Family Sponsorship and Family Visit Visas?

The requirements for a family visa to Canada depend on whether you are applying for permanent sponsorship or a temporary visit. Spouses, partners, and dependent children remain eligible for sponsorship, while parents and grandparents sponsorship is subject to limited intake periods and invitation rounds under the Parents and Grandparents Program (PGP). For visits, families can apply for a Temporary Resident Visa (TRV) or a Super Visa, which allows longer stays but requires medical insurance and proof of financial support.

Family Sponsorship Requirements (Permanent Residency)

1. Eligibility Requirements for the Sponsor

The individual who is currently residing in Canada (the sponsor) has to fulfill stringent legal requirements before a family member can be sponsored. You must:

  • Age: Must be aged 18 years and above.
  • Status: Be a Canadian citizen, a person registered in Canada as an Indian under the Canadian Indian Act, or a permanent resident.
  • Residency: Must live in Canada. Sponsorship for a spouse/partner can be sponsored by a spouse or a partner of a Canadian citizen living abroad, provided that they show the intention to live in Canada when the sponsored individual is granted permanent resident status.
  • Clean Legal Record: You cannot be subject to a removal order, imprisoned, or have an undischarged bankruptcy.
  • Social Assistance: You are not supposed to be on social assistance due to other reasons other than a disability.

2. Who Can You Sponsor? (Eligible Family Members)

Canada offers different immigration and visitor pathways for family members, depending on the relationship and purpose of travel. You may provide sponsorship for certain relatives that will be categorized as follows:

  • Spouse, Common-law, or Conjugal Partner: A spouse is legally married to the sponsor, while a common-law partner must have lived with the sponsor continuously for at least 12 months.
  • Dependent Children: Children younger than 22 years old who lack a spouse or partner. (Exception allowed in case of children, above 22, and with physical or mental conditions).
  • Parents and Grandparents: Generally operated after a lottery/interest-to-sponsor system.
  • Orphaned Relatives: Orphaned and unmarried under-18 sons, daughters, nephews, nieces, or grandchildren.

3. The Financial Requirement (The Undertaking)

The Undertaking is one of the most important elements of the application. This is a legal contract between the sponsor and the Government of Canada.

  • Financial Responsibility: You are obliged to supply the basic needs (food, clothing, shelter) of your family member.
  • Length: This commitment can be of different lengths. In the case of a spouse, this is 3 years after the day they become a permanent resident. In the case of a dependent child, it is 10 years or until the child attains the age of 25. Parents/grandparents have 20 years (10 years in Quebec).
  • Minimum Necessary Income (MNI): Although there is no MNI requirement to sponsor a spouse or a dependent child, there are MNI requirements in the event that you are sponsoring a parent or a grandparent, or when a dependent child has a child of his own.

4. Key Documentation and Evidence

IRCC requires "proof of relationship" to prevent immigration fraud. Applicants must typically provide:

  • Identity Documents: Passports, birth certificates, and national ID cards.
  • Relationship Evidence: Marriage certificates, shared bank account statements, residential leases in both names, and photographs of the couple together.
  • Medical Exams and Police Certificates: The sponsored person must undergo a medical exam and provide police clearances from any country they have lived in for more than 6 months.

Family Visit Visa Requirements (Temporary Stay)

Families who want to visit Canada without permanent sponsorship can apply for:

1. Temporary Resident Visa (TRV)

Eligibility: Citizens of visa-required countries.
Visitors are commonly allowed to stay for up to 6 months per entry, subject to the decision of the border services officer.

Documents Required:

  • Valid passport (6+ months validity recommended).
  • Completed application form (IMM 5257).
  • Family Information Form (IMM 5645).
  • Invitation letter from the host in Canada.
  • Proof of funds to cover stay.
  • Proof of relationship (birth/marriage certificates).
  • No criminal or immigration inadmissibility.

2. Super Visa (for Parents & Grandparents)

Eligibility: Parents and grandparents of Canadian citizens or permanent residents.
Stay Duration: Up to 5 years per entry.

Additional Requirements:

  • Proof of relationship to child/grandchild in Canada.
  • Minimum income proof from the host (meeting Low Income Cut-Off).
  • Valid medical insurance from a Canadian provider (coverage for at least 1 year, minimum CAD 100,000).
  • A medical exam may be required.
